JOB DESCRIPTION

Under the direction of the senior leadership in the Legal and Compliance Team, this position will serve in an advisory capacity to the Claims Team and Company regarding insurance coverage and extra-contractual disputes and litigation.

Claims Focus: Conducts research where necessary, drafts brief legal opinions, attends claim review meetings to provide legal advice, examines records, conducts investigations, attends depositions and mediations, retains and manages outside panel counsel as needed, and manages coverage and extra-contractual litigation by and against the company. Helps draft and review product forms to ensure they provide the desired coverage and benefits. Participates in negotiations on behalf of the Company including settlements. Provides leadership updates on major Company projects as necessary and expertise on any necessary training.  and expertise on training and major company projects as necessary.

 Responsibilities/Tasks:

  • Responsible for applying legal principles, knowledge and skills based on experience.
  • Evaluates and selects appropriate legal techniques, procedures and criteria using judgment in solving legal issues.
  • Conducts legal research and offers timely legal opinions and advice upon reasonable demand and with minimal supervision.
  • Utilizes a high degree of independent judgment and creative solutioning.
  • Responsible for handling complex legal projects requiring originality and ingenuity.
  • Possesses a broad knowledge of principles, practices, and procedures to the completion of coverage assignments and other claims matters.
  • Identifies risks, provides assessment of risk areas, and helps design/implement controls to mitigate such risks.
  • Serves in an advisory capacity, making recommendations which may have an important bearing on the Company’s business including, but not limited to: evaluating risk; identifying possible outcomes; and assessing the probability of those outcomes.
  • Assists in the review and drafting of policy language to meet with business objectives for a given program.
  • Plans, organizes and conducts programs, seminars, conferences and/or presentations for Company personnel to educate on legal matters, with a concentration on claims handling and management.
  • Works on different special projects as assigned.
     

Additional Claims Focus Responsibilities

  • Provides direction and legal support to Claims and Legal professionals within the Company.
  • Serves as liaison between Claims and Legal & Compliance teams within the Company.
  • Provides updates and guidance to Legal Team on high-risk Claims matters and potential and existing litigation.
  • Works with outside counsel as point of contact in coordinating research, formulating business strategy in resolving coverage issues and extra-contractual litigation, preparing for and attending depositions.
  • Prepares for and attends hearings and appeals.
     

EMPLOYMENT QUALIFICATIONS:

Education
A Juris Doctor Degree and admission to the bar (in good standing) in employed state(s) required. Continuous learning, as defined by the Company’s learning philosophy, is required.

Experience
A minimum of five (5) years of experience handling coverage matters or coverage litigation in-house or in private practice. In-house insurance industry experience a plus.
Skills/Knowledge/Abilities (SKA) Required

  • Knowledge of federal and state laws and regulations governing insurance as well as corporate governance.
  • Ability to understand complex legal issues.
  • Understanding of the business and appreciation of financial/analytical issues and profit and loss implications
  • Ability to work independently and illustrate sound judgment as well as work in a team environment and encourage others to exercise professional judgment.
  • Excellent analytical, negotiation, organization, and verbal & written communication skills.
  • Qualified to effectively present information and respond to questions from courts, regulators, clients, customers and the general public.
  • Effective leadership, management and advocacy skills.
  • Ability to interface in complex cross-functional business environment and build rapport with legal counsel and business colleagues at all levels of the organization to engender confidence in decision making and judgment.
  • Ability to develop optimistic and collaborative relationships and to help influence decision making by senior management.
  • Strong problem solver, excellent project management skills, attention to detail.
  • Skilled in development of policies, procedures, training methods and materials.
  • Working knowledge of corporate policies and procedures.
  • Working knowledge of contracting principles.
  • Ability to draft and review contracts.  
  • Ability to read, analyze and interpret statutes, general business and legal periodicals, professional journals, technical procedures and governmental regulations.
  • Highly developed sense of ethics and integrity.
  • Demonstrates curiosity.
